YOUTH CHARTER
Of the German Wind Band Youth
Within the Confederation of German Music Federations (BDMV)

§ 1 name, domicile and accounting year
(1) The German Wind Band Youth ist he youth organisation of the Confederation of German Music Federations.
(2) The German Wind Band Youth is an association without legal capacity within the BDMV which is enlisted within register of associations.
(3) It has ist domicile in Stuttgart.
(4) It avows itself to the aims and goals of the BDMV.
(5) The accounting year is the legal year.

§ 2 Aim
(1) The German Wind Band Youth has the function to seize the common interests of their member federations at federal level in state and society, to represent them in Germany and abroad, to support advanced trainig and further education, to give advice to the member federations and to set up guidelines for the education of the youth, to hold central meetings of member federations, the set up events on federal level, to communicate and arrange international exchanges, to accomplish public relations on federal level.
(2) The German Wind Band Youth supports making music in contemporary groups.
(3) It wants to contribute to character formation, support social behavior, activate the social engagement of youths making music and to spark the readiness of for international understanding through exchanges and meetings.
(4) In cooperation with confederations and institutions the German Wind Band Youth wants to advance forms of musical youth work, to represent the common interests of the Wind Band Youth in musical and general youth issues and wants to act in youth and social politics.

§ 3 Fundamentals
the follwoing fundamentals are the guidelines for the work of the German Wind Band Youth:
1. The ultimate ambition is the common acting of the member federation in super-federal issues.
2. The autonomy of its member federations is inviolated.
3. The GWBY is party political neutral. It is commited to the free democratic basic order of the Federal Republic of Germany. It stands up for human rights and world-viewing and religious tolerance.
4. The GWBY is acting with the belief that music is of inestimable value for intellectual, emotional and cultural development. Its constant effort is to effect understanding and cooperation for fosterage and support of music in society.
5. The GWBY wants to activate young persons to independance, individual responsibility and capacity for team work. So it wnats to give assistance to the development of their personality.
6. Through international meetings the GWBY is contributing to international understanding.

§ 4 Benefit to the public
(1) The GWBY is exclusively and directly pursueing charitable aims in terms of the chapter “tax-advantaged aims” of the General Fiscal Law.
(2) The German Wind Band Youth is acting altruistic. It does not pursue goals primarily serving its own economic interest.
(3) Financial means of GWBY are only to be spended for aims of this youth charter. The members do not get any allowances out of financial means of GWBY.
(4) Persons must not be fostered by expenditures that are diverting from the intended aims of the German Wind Band Youth or which are out of scale.
(5) In case of annulment or abrogation of the German Wind Band Youth or the abolition of tax-advanteged aims all financial means have to be committed to BDMV as long as they meet the premises of benefit to the public verifiably. BDMV is spending the capital exclusively and directly for youth work in accordance to § 3 of its charter.

§ 5 Member federations
Members of the German Wind Band Youth are the youth organisations of the regular member federations of BDMV which are accredited as charitable.

§ 6 Duties and Rights of the member
(1) The members are committed to support aim and issues of the German Wind Band Youth within their federations and in public. They are to consider the decisions of the elements of the GWBY and to compound the fee decided by the general meeting. Beyond that they are to help the GWBY to enforce actions by donations or other.
(2) The members have the right to take part in the general meeting and in events of the German Wind Band Youth to file applications therefor and to get advice by appropriate elements of the GWBY or BDMV at no charge.

§ 7 Acquisition and loss of membership
(1) The membership is to be given by the youth panel on written application. This is not valid for founding members.
(2) The memberships may be deprived by the youth panel if a member contravenes against this charter or decisions of the general meeting or if a member effectively damages the credit of GWBY. In three months time after arrival of the decision of losing membership a member can call the general meeting against the decision of the youth panel. The decision of the general meeting is irrevocable.
(3) At the end of the legal year the withdrawel can be announced by written resignation within a time of six months.
(4) With the end of the membership any claims to the GWBY expires.

§ 8 Elements
elements of the German Wind Band Youth are
1. the general meeting (§ 9)
2. the youth panel (§ 11)
3. the executive board (§ 12)
The gender ratio should be ballanced within all elements.

§ 9 The general meeting
The general meeting is composed of
1. the delegates appointed by the member federations,
2. the members of the executive board.
2) The general meeting is taking place every four years. The youth panel can call a extraordinary general meeting if one third of all member federations is applying for that in written form and with a stated agenda.
(3) The executive board summons the general meeting at least six weeks before start of the meeting through written information to the member federations stating an agenda and the place of the meeting.
(4) The general meeting ist he highest element of the German Wind Band Youth and has to determine general issues of super-federal impact.
ts taks are especially:
1. election of the executive board
2. acceptance of the annual reports
3. approval of maintainance of budget and authorisation of the principles of future maintainance of budget.
4. exculpation of the executive board because of the maintainance of budget of the last three years
5. decision on the appointment and annulment of permanent committees.
6.fixation of the member fee
7. decision on the appeal against the expulsion of a member
8. modification of the youth charter
9. acceptance and modification of the bylaws.

§ 10 voting rights and decisions
(1) Every member has voting right in the general meeting. The voting right can be executed by delegates which are sent on basis of the charters of member federations. Accumulation and transfer of votes are not possible.
(2) Member federations have delegates in the general meeting according to their members under 27 years: one delegate per 7.000 members under 27 years and one delegate per additional 7.000 members and parts thereof. Every member of the executive board has voting rights in the general meeting. The GWBY is bearing the costs for members of the executive board. Delegating federations are bearing the costs for their representatives.
(3) The duly called general meeting definitely has the quorum. To make valid decisions the bare majority of the attendant crowd is sufficient. A 2/3 majority is needed for making decisions if half of the attendant crowd demands it. The casting of votes is held open or as a ballot vote if one third of the attendant crowd asks for it. Abstention is counted as not participated.
(4) Decisions about the modification or annulment of the German Wind Band Youth require a ¾ majority of the attendant crowd.

§ 11 The youth panel
(1) The youth panel is composed of
1. members of the executive board and
2. the chairpersons of the member federations (or their representatives).
(2) The tasks of the youth panel especially are
1. Discussion and decision-making about issues of general relevance as long as they are not reserved for the general meeting or they cannot be delayed until the next general meeting.
2. Election of cash auditors.
3. Proposals fort he election of the chairperson as well as all other members of the executive board.
4. Honorary membership/ honorary titles.
Persons which have aquired special earnings about the work of GWBY can be appointed honorary member with or without title by proposal of the executive board. They have no voting rights but act in a purely advisory capacity.
5. Resolution about annual accounts and proposal of the budget as well as exculpation of the executive board except rights of the general meeting after § 9 para. 4 No. 3 and 4. except for the year of the general meeting.
(3) The youth panel should come together at least one time per year. It is called up in written form at least six weeks before the date of the meeting by the executive board. Invitations by phone or a shorter period of time are acceptable if urgency is needed. The executive board has to call up a youth panel if at least one third of the member federations asks for it and state an agenda.
(4) A decision is made if the majority of the attendant crowd agrees. Abstention is counted as not participated. Ballot vote can be requested by every member. The duly youth panel definitely has the quorum. If it is called up by phone or short-dated it only has the quorum if at least half of its members are present.
(5) The youth panel is authorized to substitute every member of the executive board until the next general meeting if his/her function is terminated abnormally.

§ 12 The executive board
The excutive board is composed of:
1 chairperson of the board
4 vice chairpersons with the subjects:
administration of business, public relations, music, non artistic youth work and education
and up to 4 committee members.

The vice chairpersons act as team leaders for their spezial subjects.The filling of the teams is carried by the member federations which delegate persons into the teams upon agreement with the team leaders.
The chairperson of the board andthe vice chairperson with the subject administration of business are legal agents of GWBY in terms of §26 Civil Code.
The actual allocation of tasks in the executive board is regulated by the bylaws.
(2) The executive board is elected by the general meeting fort he time until the next regular general meeting.
(3) The excutive board is caring fort he issues of GWBY in terms of and while regarding the youth charter and the decisions of general meeting and youth panel. The executive board is responsible for a proper accomplishment of business dealings of GWBY and decisions of the elements.

§ 13 administration of business, minutes
(1) Current business dealings are carried out by the own office of GWBY.
(2) Minutes about the general contents and decisions have to be made for all meetings. They have to be signed by the chair of the meeting and the editor. The chair of te meeting appionts the editor.
(3) The GWBY may give itself a bylaw.

§ 14 Final clause
(1) The charter of BDMV is securing in §12 that GWBY is acting independently in leadership and afmisnistration including the decisions about the deployment of the accrueing financial means.
(2) The youth charter and any modification of it need to be approved by the excutive board of BDMV.
(3) The elements of GWBY decide about the budget planning and the annual accounts. These decisions have to be approved by the executive board of BDMV.
Devised by federal secretary Nägele as proposal for the panel of BDBV on August 11 and 12, 1979 and edited on October 21, 1981 for the general meeting of GWBY in Januar 1982 in Kürnbach.
Modified and agreed on by the general meeting of GWBY on March 1, 1997 in Hamburg. The panel of BDBV has approved the modification on April 26, 1997 in Eisenach.
Modified and agreed on by the general meeting of GWBY on March 22, 2003 in Bonn und tritt mit ihrer Beschlussfassung in Kraft.
